Macy’s sues Martha Stewart Living

Martha’s Stewart’s company may be in BIG trouble…

According to the Associated Press, Macy’s Inc. has sued Martha Stewart Living Omnimedia Inc. in a bid to block a licensing deal between the housewares company and J.C. Penney Co.

The lawsuit was filed Monday in New York State Supreme Court. Macy’s claims Martha Stewart Living’s deal with J.C. Penney violates the terms of an exclusive pact Macy’s has to sell Martha Stewart Living products at its stores, according to reports in The Wall Street Journal and other publications.

The complaint comes after Plano, Tex.-based J.C. Penney acquired a 16.6 percent stake in Martha Stewart Living and announced plans last month to open mini-Martha Stewart shops inside most of its stores, beginning next year. The deal announced last month was seen as part of J.C. Penney’s efforts to re-image itself under its new CEO Ron Johnson, a former Apple Inc. executive.

Cincinnati-based Macy’s has asked the court for a preliminary injunction to block the deal.

Martha Stewart Living said it does not comment on legal matters, but issued a statement saying that it received a notification from Macy’s that it intends to renew and extend its commercial agreement with Martha Stewart Living to feature and promote the Martha Stewart Collection in Macy’s stores.

The New York-based lifestyle, media and merchandising company also noted that its commercial agreement with J.C. Penney remains in effect.

Calls and an email seeking comment from Macy’s and its attorney were not immediately returned late Monday.

Macy’s shares added 9 cents in aftermarket trading. The stock ended regular trading down 29 cents at $35.09.

Martha Stewart Living shares slid 15 cents, or 3.5 percent, to $4.15 in aftermarket trading after slipping 13 cents, or 2.9 percent, to $4.30 during the regular session.

Yung Joc Sued By Production Company

Yung Joc is being sued by an Atlanta-based production company, which claims that the southern rapper signed a contract with them that gave them control over his recordings.

 According to Master Mind Music Inc.’s complaint, which was filed in United States District Court, Northern District of Georgia earlier this week, Joc signed an artist development and exclusive recording agreement with them in February 2005 that stated that all material he created during the duration of the contract would be the property of MMM. Under the agreement they were also entitled to copyright his songs under the production company’s name, obtain a 50% share of his publishing and co-ownership of all of his recordings.

Master Mind Music is asking for an undisclosed amount of money for the alleged copyright infringement, breach of contract, torturous interference with contractual relations, fraudulent misrepresentation and fraud.

Yung Joc has not responded publicly to the lawsuit yet.

Regis Philbin sells Conn. house for $3 Million

Former Live television host Regis Philbin and his wife, Joy, have sold one of their Connecticut homes in a real estate transaction which could have netted them  millions!

The Greenwich Time reports (http://bit.ly/ye4QCb ) that town legal records show the Colonial home in Greenwich was placed on the market for $3.8 million in July and sold for $3 million in September 2011.

The buyer, Raymond LaChance, told the newspaper that the fact that Philbin is the former legal owner is “kind of neat,” but that did not influence his and his wife’s decision to purchase the house.

The home has nearly 6,000 square feet of space and sits on six acres near a state park. It also includes a pool, a tennis court and a gazebo.

The Philbins own another home less than two miles away and an apartment in Manhattan.

Rapper Petey Pablo Wanted on Federal Gun Charges

North Carolina Rapper Petey Pablo, who was arrested at Raleigh-Durham International Airport last month on gun charges, is now wanted by federal authorities.

A federal arrest warrant charges Pablo, whose real name is Moses Barrett III, with possession of a firearm by a felon, possession of a stolen firearm and trying to take the gun on an airplane.

Police arrested the 37-year-old on Sept. 11 after a gun was found in his carry-on luggage during a security check, said airport spokeswoman Mindy Hamlin.

He was charged with carrying a concealed weapon, possession of a firearm by a felon and possession of a stolen firearm. The weapon was a Smith & Wesson 639, arrest warrants showed.

Pablo was trying to catch a flight to Los Angeles for the 2010 MTV Video Music Awards, according to a Wake County magistrate.

Pablo was arrested in Raleigh in 1993 on armed robbery charges and sentenced to 14 years in prison.

He is best known for his hit songs “Raise Up” and “Freek-a-Leek.”

Floyd Mayweather’s 90 day Jail Sentence Postponed so he can Fight in Las Vegas Boxing Match!!!!

There is good and bad news for boxer Floyd Mayweather, Jr.

Floyd Mayweather Jr. won’t have to turn himself in to a Las Vegas jail until June 1, 2012 … so he can fight in Las Vegas on May 5th … the judge just ruled.

Floyd was supposed to turn himself in today to begin his 90-day sentence for beating up his baby mama, Josie Harrisafter pleading guilty to two counts of harrassment and one count of domestic violence — but his attorney had asked the judge to postpone the boxer’s turn-in date to June 1 … to give Floyd time to train for a massive fight on May 5th against an undetermined opponent at the MGM Grand.

His attorney’s justification … Floyd’s a pro who brings in hundreds of millions in profits for the city of Las Vegas — and hey, thing’s get rescheduled all the time … no bigs.

Several of Floyd’s famous friends came to court to support the boxer — including Ray J and Lil Kim who told media on their way out of court, they showed up for Floyd as an act of solidarity.

Floyd Mayweather is not properly licensed to fight in Nevada on May 5 … despite having the judge’s blessing … officials are demanding to speak with Floyd in person before they will allow him to fight.

Keith Kizer, Executive Director of the Nevada State Athletic Commission, told TMZ that all fighters must apply for a license annually … but fighters with a conviction are sometimes required to plead their case to the commission in person.

Wiz Khalifa Sued by Pennsylvania Rapper for $2.3M; claims “Black and Yellow” is his song!!!

A Pittsburgh rapper is suing hip hop star Wiz Khalifa for $2.3 million over allegations that he stole the hit song “Black and Yellow.”

Max Warren performs under the stage name Maxamillion. He says Khalifa’s chart-topper “Black and Yellow” was lifted from his own song “Pink N Yellow.”

Warren says he copyrighted “Pink N Yellow” in 2008 and Khalifa copyrighted “Black and Yellow” in 2011.

The copyright infringement lawsuit was filed in federal court in Philadelphia and seeks at least $2.3 million in damages. It names Khalifa, whose real name is Cameron Jibril Thomaz, two other songwriters and several record companies and music publishers.

Warren’s lawyer declined to comment Thursday. A spokesman for Khalifa at Atlantic Records didn’t immediately respond to an email seeking comment.
