MTV “Teen Mom” star rejects house arrest plea deal

7 May

Amber Portwood made her claim to fame when she was featured on MTV’s “16 & Pregnant” reality show and then continued on to star in “Teen Mom.” Besides getting pregnant at 16, Portwood has found herself facing felony charges from her conduct on the television show.

In this episode of her legal saga, Portwood  rejected a prosecutors’ offer that would have kept her out of jail on felony domestic battery and child neglect charges.

Police in Anderson, Indiana investigated the then-20-year-old Amber Portwood after a September episode showed her slapping, choking and kicking the then-24-year-old father of her daughter. Television viewers watched in horror as she was filmed striking ex Gary Shirley, 24 , in front of their two-year-old daughter Leah last year.

Officials say dozens of viewers called the state’s child abuse hotline to report Portwood’s outbursts.

Under Indiana law,  “(a) A child is a child in need of services if … the child’s physical or mental health is seriously endangered due to injury by the act or omission of the child’s parent, guardian, or custodian.” (Indiana Code 31-34-1)

Portwood had her child taken from her by Indiana’s Child Protective Services due to the violence in the home — she reportedly assaulted Shirley three times between August 2009 and July 2010. Video footage was subpoenaed by the court to ascertain the magnitude of Portwood’s alleged offenses. Authorities would later place Portwood’s child, Leah, in protective custody after they announced she would be monitored for up to six months.

Portwood attended a Madison County court hearing Thursday. She told The Herald Bulletin she wouldn’t be able to do her job as a mother if she accepted the plea deal of 90 days on house arrest and two years of probation.

The judge gave Portwood and her attorney 60 days to work out a new plea deal or go to trial. E! Online reported that  Portwood broke down into tears following the announcement that her trial was going forward and had been set for Nov. 16.

She is facing three felony charges–two counts of domestic battery and one count of neglect of a dependent, along with one misdemeanor charge of domestic battery.

To no avail, her ex-boyfriend, Gary pleaded with the judge to lift the no-contact order that’s preventing Portwood from seeing Shirley while their daughter is present. The judge denied his request.

CBS News reported that  Portwood.  Maci Bookout, Catelynn Lowell and Farrah Abraham will be returning for a third season of “Teen Mom” set to premiere on July 5.  But Portwood, 20,  faces one misdemeanor count of domestic violence and two felony counts of domestic battery and could get up to 3 years in prison if convicted and be fined up to $10,000 (a small sum considering she made $280,000 for appearing on Teen Mom).
