The Gap Fights Back against Kim Kardashian Lawsuit

In the latest development of the KIM KARDASHIAN lawsuit against The Gap, the clothing company has fought back.

Last year celebrity reality star Kim Kardashian  sued The Gap clothing brand for a ridiculous $20 million for using her not-so-subtle lookalike, model Melissa Molinaro in their Blue Navy TV commercials ( The Gap owns Old Navy).  In her lawsuit, Kim K alleged that the commercial “created confusion in the marketplace and violated her rights to her name and likeness.”

Under common law, one who appropriates to his own use or benefit the name or likeness of another is subject to liability to the other for invasion of his privacy.

But The Gap has since rolled up it’s legal sleeves and released a bombshell of it’s own…

In an interesting twist in their legal battle, the retailer has launched an investigation to see whether Kim K’s reputation really was damaged as per her lawsuit. In the scheme of things, this investigation could take about a year to complete, according to The New York Post‘s legal experts.

Investigators for the Gap also intend to speak with representatives from Bebe and Sears, two retailers that used to have professional relationships with Kim Kardashian in the past.

The Gap has a few aces up their sleeves in their defense. One is to prove that Kardashian is “libel-proof,” meaning that her reputation is so bad that no single thing could cause true damage.

Secondly, The Gap also intends to prove that Kardashian is not actually as good a performer as Molinaro, the talent Old Navy hired for the spot.

Kim Kardashian is fighting back on claims her marriage to Kris Humphries was BOGUS.

The 31-year-old Kardashian has hired lawyer Marty Singer to muzzle Jonathan Jaxson, her former publicist who has been making the media rounds claiming Kardashian’s wedding was nothing but a publicity stunt.

“It was obvious that it was staged,” Jaxson recently said on “Good Day L.A.” “There were contracts already in place for E! to film it. Everything was written down.”

According to court documents supposedly obtained by TMZ, Kardashian claims Jaxson’s defamatory statements have hurt her reputation, and she is seeking a minimum of $200,000 in damages. ( Jaxon says he has yet to have been served with such documents)

Though Jaxson says he worked for Kardashian from 2007 to 2009, TMZ reports the two only worked together on one project – a blog – years ago, and that Jaxson is now in violation of a signed confidentiality agreement.

Jaxson fired back posting contracts for appearances and events that they worked on together on his website. You can view them here.

Jaxson addressed the lawsuit on his personal blog Sunday.

“To the best of my knowledge, I have never signed an agreement dealing with confidentiality with Kim Kardashian. I have an agreement in my possession that does not have either parties signature on it,” wrote Jaxson, who added that many of his recent statements have been based on conversations with friends he and Kardashian share.

He continued:

When I have been contacted by the press to give comments on the wedding, my opinions have been from my personal point of view based on the statement she posted on her blog and conversations with mutual friends. 


Regarding her engagement ring from Kris, I have stated that is was quite similar to the same ring I staged with her for a story we released to the press back on December 26, 2007. It was a planned shoot as she exited XIV Jewelers in Beverly Hills with the 7-carats on her right hand for media speculation that she was engaged, as she exited the jeweler. 


I have not worked with Kim in a professional capacity in a couple of years and have absolutely no ill feelings towards her what so ever. The work we did together, I did as an acting publicist/friend on the side “behind-the-scenes” for her from 2007-2009. The pictures online, along with a video blog, and audio together speak for themselves. 

Kardashian took to her blog earlier this month to defend her short-lived marriage to Humphries.

“I married for love,” she wrote. “I can’t believe I even have to defend this.”

Kim Kardashian SUES Old Navy For Hiring A LOOK ALIKE In Their TV Commercial!!!

Kim Kardashian has a legal beef to pick with Old Navy for using a Kim K look-alike in a recent ad campaign.

According to TMZ, Kim is filing a lawsuit against the clothing giant  — claiming they intentionally used a look-alike in an effort to dupe the public into thinking Kim was affiliated with Old Navy.  Old Navy is owned by the makers of Gap and Banana Republic.

According to the website, Kim is especially furious that Old Navy has been tweeting to her page about the look-alike — in an effort to gain even more publicity.

One of those tweets read, “@CBSNEWS reports that Old Navy’s Super CUTE star looks like @kimkardashian. #LOL. What do you think?”

According to TMZ, which is owned by lawyer, Harvey Levin,  the copycat campaign has damaged Kim’s pocketbook somewhere in the range of $15 to $20 million.

Let the Prenuptial Negotiations Begin: Kim K and Kris Humphries are ENGAGED!!!

Let the games begin! Kim Kardashian and Kris Humphries have probably already secured the attorneys and ordered the prenuptial agreements drafted. According to US News, the couple is engaged to be married. I wonder if the wedding will be featured on Kim’s reality show, Keeping Up with the Kardashians…

Kardashian, 30, and New Jersey Nets forward Humprhies, 26, began dating in December, and the duo quickly became serious.Last month, a Kardashian insider told Us Magazine that the E! star planned to move to NYC in order to be closer to her man. “This is it for her,” the source said. “I foresee an engagement this summer.”

A prenup is inevitable. According to ESPN, Kris Humphries salary with the Nets in 2011 alone is $3,200,000. Kardashian is no pauper herself. She is the highest paid reality star, topping the Daily Beast’s 2010 Highest Paid Reality TV Stars list for bringing in a whopping $6 million in product endorsements including diet products and other infomercial-esque goods.

So what about the engagement ring you ask? Kim Kardashian’s engagement ring is worth almost HALF as much as her Beverly Hills mansion. According to TMZ and sources close to the diamond, the rock is valued at $2 MILLION!!!!!!
